Terms of Service

Effective Date: 24 March 2025.

1. Acceptance of Terms

By accessing or using the Reperio mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, please do not use the App.

2. Description of Services

The App provides the following core features:

• Object Scanning & Estimation: Use your device’s camera to scan physical objects. Images are processed by our AI system (leveraging technology similar to ChatGPT) to provide an estimated value for each object.
• Data Storage: Your object estimations and related data are stored securely on our backend.
• Premium Features: Users can upgrade to a Premium subscription via In-App Purchases (IAP), which unlocks unlimited object estimations.
• Account Management & Data Deletion: All information connected to your account will be permanently deleted upon account deletion. This includes saved estimations and personal data, in compliance with GDPR.

3. Eligibility & Account Registration

• Eligibility: You must be at least 13 years old to use the App. If you are under 18, you must have permission from your parent or legal guardian.
• Account Registration: To access certain features, you may be required to create an account. You agree to provide accurate and complete information during registration and to update such information as necessary.

4. User Responsibilities

• You agree not to misuse the App, including but not limited to attempting to bypass or disrupt any security features or interfering with other users' access.
• Your use of the scanning and estimation features does not constitute professional advice; the estimated values are provided for informational purposes only.
• You are solely responsible for any content you upload or generate through the App, including object images and estimations. We are not responsible for any consequences that result from your use of the estimates provided by the App.

5. Payment & Premium Subscriptions

• In-App Purchases: The Premium subscription, which unlocks unlimited object estimations, is available via IAP. All purchases are subject to the terms and conditions of the respective app store.
• Billing: Subscription fees will be charged to your account based on the pricing and billing cycle selected.
• Refunds: Due to the nature of digital products and services, all In-App Purchases (IAP) are non-refundable except as required by law. Please refer to the respective app store's refund policy for more details.

6. Data Privacy & Account Deletion

• Data Collection & Use: For more information on how we collect, use, and safeguard your data, please review our Privacy Policy.
• Data Deletion: In compliance with GDPR, if you choose to delete your account, all data associated with your account (including saved object estimations and personal information) will be permanently deleted from our systems.
• Security: We implement reasonable measures to protect your data, but cannot guarantee complete security against unauthorized access.

7. Disclaimer

The estimations provided by the App are for informational purposes only. We do not guarantee that the estimates will be accurate, reliable, or suitable for any specific purpose. The operation of the App may be interrupted or contain errors, and we do not warrant that the App will meet your requirements or that its operation will be error-free. We disclaim all express and implied warranties, including, but not limited to, warranties of merchantability or fitness for a particular purpose.

8. Warranties and Limitation of Liability

The App is provided "as is" and we do not make any warranty or representation regarding the App’s quality, accuracy, reliability, or performance. We shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, loss of data, or any other financial loss arising from the use of the App. Our liability shall be limited to the amount you paid for the Premium subscription or software, whichever is applicable.

9. Modifications to Terms

We may update these Terms from time to time. Updated Terms will be posted in the App and will become effective upon posting. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.

10. Price Adjustments

We reserve the right to adjust the price of the Premium subscription at any time. Users will be notified in advance of any price changes. Discounts provided are applicable at the time of purchase and are not guaranteed for future renewals.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions. You agree that any legal action arising out of these Terms or your use of the App shall be filed in the appropriate courts located in Ottawa, Ontario, Canada.

13. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Reperio regarding the use of the App.

Reperio ("we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you use our mobile application, Reperio ("the App").

• Images uploaded by users for object scanning.

• This data is securely stored in our backend, powered by PocketBase.

c) Subscription Data

• Information related to In-App Purchases (IAP) for premium services, such as subscription status and payment history.
• Payment data is managed and processed by the respective app stores (Apple App Store or Google Play), and we do not store or process payment information directly.

d) Usage Data

• Data collected about user interactions with the App, including session duration, feature usage, and error reports.
• Analytics data used to improve the App’s performance and functionality.

3. How We Use Your Information

We use the information we collect for the following purposes:

• To Provide Core Functionality: Process images and generate AI-based object estimations.
• To Manage User Accounts: Authenticate and manage user accounts, including subscription status.
• To Improve Services: Analyze user behavior to enhance app performance and introduce new features.
• To Process Payments: Manage subscriptions and handle billing through app stores.
• To Ensure Legal Compliance: Meet regulatory and legal obligations and prevent fraudulent activities.

Legal Basis for Processing (GDPR Compliance)

For users in the European Economic Area (EEA), we process personal data based on the following legal grounds:

• Consent: For processing object images and generating AI-based estimations.
• Contract Performance: To provide account management and process subscriptions.
• Legal Obligations: To comply with applicable laws and prevent fraud.

AI Estimation Disclaimer

Please note that AI-generated object estimations are provided for informational purposes only and may not always reflect accurate market values.

We do not sell, rent, or share personal information with third parties, except as required by law or where necessary to provide core functionalities.

4. Data Retention and Deletion Policy

a) Data Retention

We retain personal information for as long as necessary to provide our services and fulfill the purposes outlined in this policy.

• User content, including object images and estimations, is retained while the account remains active.
• Subscription and account-related information is retained as required by law or for legitimate business purposes, including tax and accounting requirements.

b) Data Deletion

When a user chooses to delete their account through the App:

• All associated personal data, including uploaded images, AI-generated estimations, and account information, will be permanently deleted.
• Data is deleted in accordance with applicable laws, including PIPEDA and GDPR.
• Residual Copies: Residual copies of deleted data may persist in encrypted backup systems for up to 7 days, after which they will be permanently purged.

5. Security Measures

We take reasonable and appropriate measures to protect your data from unauthorized access, alteration, disclosure, or destruction. Our security measures include:

• Encryption of sensitive data both in transit and at rest.
• Secure storage of user data using PocketBase.
• Access controls and regular security audits to ensure compliance with industry standards.

Data Breach Notification

In the event of a data breach that affects your personal information, we will notify affected users and relevant authorities as required by applicable laws.

While we strive to protect your personal data, no method of transmission over the internet or electronic storage is completely secure. Users are encouraged to take steps to protect their account credentials.

a) Rights Under Canadian Law (PIPEDA)

If you are a resident of Canada, you have the following rights under PIPEDA:

To maintain system integrity, prevent abuse, and ensure fair access to our services, this Fair Use Policy outlines acceptable usage limits and establishes guidelines to prevent misuse of our Premium unlimited estimation feature.

By using Reperio, you agree to comply with this Fair Use Policy. Failure to adhere may result in suspension, limitation, or termination of your account.

1. Purpose of the Fair Use Policy

The Premium subscription offers unlimited object estimations to provide enhanced value to our users. However, to maintain a stable service and prevent misuse, we implement reasonable usage limits to safeguard system performance and ensure fair access for all users.

This Fair Use Policy is designed to:

• Prevent excessive use that may degrade the experience for other users.
• Protect system resources and prevent automated or unauthorized requests.
• Ensure compliance with applicable laws and ethical use of AI technologies.

2. Definition of Fair Use

While Premium users have access to unlimited object estimations, fair use means that usage:

• Remains Reasonable and Non-Excessive: Your use should align with typical usage patterns of individual users, not automated or bulk processing.
• Does Not Disrupt Service Availability: Excessive requests that degrade system performance, create server overload, or negatively impact other users are not permitted.
• Is Limited to Personal or Business Use: Premium usage is intended for legitimate personal or professional purposes. Automated or commercial mass processing of images is strictly prohibited.

3. Examples of Fair Use Violations

The following activities are considered violations of this Fair Use Policy:

• Automated or Programmatic Usage: Using scripts, bots, or automated systems to perform continuous or excessive estimations.
• Mass Uploading or Batch Processing: Uploading large volumes of images in a short period to overwhelm the system.
• Reselling or Sharing Accounts: Sharing Premium account access with multiple users or reselling estimations is prohibited.
• Excessive Requests Beyond Normal Usage: Uploading images at a frequency or volume significantly exceeding that of an average user.

4. Reasonable Usage Limits

To prevent abuse, we may enforce the following reasonable limits:

• Daily or Hourly Limits: Although Premium users can perform unlimited estimations, we reserve the right to impose soft caps to prevent server overload.
• Detection of Excessive Usage: We may monitor user activity to identify abnormal patterns that suggest potential abuse.
• API Rate Limits: If we detect automated or bot traffic, we may temporarily restrict access to maintain service stability.

Note: Reasonable limits are dynamically adjusted based on average usage trends and are not intended to restrict normal usage by legitimate users.

5. Enforcement and Consequences

We reserve the right to take action against accounts violating this Fair Use Policy, including but not limited to:

• Temporary Suspension: Accounts that exceed reasonable usage limits may be temporarily suspended to restore system stability.
• Rate Limiting: We may reduce request frequency or impose rate limits on accounts engaging in excessive usage.
• Account Termination: Repeated or egregious violations may result in permanent account termination, with no refund for any active subscription.

6. Monitoring and Compliance

To ensure compliance with this Fair Use Policy:

• We use automated systems to detect suspicious or abnormal usage patterns.
• We may contact users to verify legitimate usage if abnormal patterns are detected.
• Users may be required to provide additional information to confirm that their use complies with this policy.
